HOW IT WORKS
1. Take Screening

2. E-File with the Clerk's Office Free
File the paperwork for free. For Anti-harassment Petition & Order the court may charge a filing fee. The court will reply to you electronically with information on how to pay for that process. The Clerk’s office will reply to you electronically with any questions or directions for you.
3. Consult Advocate (Optional)
Depending on your case you can consult a free victim advocate or court self help center for guidance. These resources, typically funded by the government, can help you review your case documents and provide direct consultation to discuss your case and safety planning.
4. File with the Clerk
You can formally begin your case by filing with your local court. The correct court will be displayed, as it is important to submit to one with jurisdiction over your case. You can digitally sign and e-file without the need to download or to print the forms. You have the option to download and print the forms and file in person.
TYPES OF CIVIL PROTECTION ORDERS (CPOs)
Domestic Violence Protective Order
In Guam, a Domestic Violence Protective Order (DVPO), under Title 7 GCA § 40101 et seq., is a civil order of protection issued to prevent further abuse by a family or household member. It addresses acts like bodily harm, threats, and intimidation, offering safety measures such as no-contact provisions, residence exclusion, and temporary custody arrangements. DVPO is also called a family violence order of protection.
Change Order of Protection
The Cancel or Change an Order of Protection case in Guam allows individuals with an active protection order to request the court to dismiss, extend, or modify its terms. It is intended for the Petitioner or protected person who wants to update the order due to changed circumstances. If approved, the person gains a revised order that better fits their current safety needs, relationship status, or legal situation.
Stalking Protection Order
In Guam, a Stalking Protection Order under Title 7, Chapter 40B protects individuals from stalking behaviors that cause fear or harassment. Victims can request temporary or final orders, regardless of age or police involvement. The court may restrict contact, ban surveillance, and order firearm surrender. Violating the order is a criminal offense. These orders aim to ensure safety and are enforceable upon issuance after a petition and court hearing.
Report Violation of Order
The Report Violation of an Order of Protection case in Guam is for individuals who already have an active protection order and believe the Respondent has disobeyed its terms. The target audience is the Petitioner or protected person seeking enforcement of the court’s order. If approved, the court may hold the Respondent in contempt, impose penalties or arrest, and reinforce the validity and protection provided by the existing order.
Sexual Offense Protection Order
In Guam, a Sexual Offense Protection Order is a civil order under Title 7, Chapter 40A, protecting individuals from nonconsensual sexual contact or penetration. It applies regardless of age or police report. The court may issue temporary or final orders restricting contact and access to the victim. Violations are criminal offenses, punishable by jail and fines. Orders may include firearm surrender and are enforceable immediately upon issuance.
