TYPES OF PROTECTION ORDERS
Order of Protection
An Illinois Order of Protection is for people experiencing “abuse” by a “family or household member”, commonly a spouse/ex, dating partner, co-parent, roommate, or relative. “Abuse” includes physical abuse, harassment, intimidation, interference with personal liberty, or willful deprivation. It can order no contact/stay-away, remove the respondent from a shared home, set parenting-time protections, and require firearm surrender. There is no filing fee and no sheriff service fee. Stalking No Contact Orders
A Stalking No Contact Order (SNCO) in Illinois is a court-issued civil order designed to protect individuals who are victims of stalking. Unlike an order of protection, which is typically tied to a family or household relationship, a stalking no contact order can be sought against any person who is stalking the victim, regardless of whether they have a personal relationship.
Civil No Contact Orders
A Civil No Contact Order (CNCO) in Illinois is a civil court order that provides protection for victims of non-consensual sexual conduct or sexual penetration, regardless of whether criminal charges are filed. It is available under the Illinois Civil No Contact Order Act (740 ILCS 22) and is intended to give survivors of sexual assault a legal remedy to prevent further unwanted contact from the offender.
Firearms Restraining Order (FRO)
It helps protect people from someone who may be dangerous with firearms. It can benefit family or household members, such as a spouse, parent, or child. An FRO can temporarily stop firearm possession, purchases, and access to ammunition. Filing and service have no fees under the law. (430 ILCS 67, Firearms Restraining Order Act)
