Osceola County, Florida
Prepare and E-file your Injunction Online
Find out which injunction fits your situation, create the court forms online in a friendly way, and then click to E-file them with the Osceola County Clerk of the Circuit Court.

HOW IT WORKS

1. Take Screening
Start with an online screening tool to help you decide which injunction fits your situation best.

2. Prepare Documents
Instead of reviewing the legal forms PDFs yourself, you will be guided through a series of friendly questionnaires that gather your information topic by topic. The questions are written in plain, non-legal language. To make this process as simple as possible, our system will generate the official court forms with your responses automatically filled in.

3. Consult Advocate (Optional)
Depending on your case, you can consult a free victim advocate or court self-help center for guidance. These resources, typically funded by the government, can help you review your case documents and provide direct consultation to discuss your case and safety planning.

4. File with the Clerk
You can formally begin your case by filing with your local court. The correct court will be displayed, as it is important to submit to one with jurisdiction over your case. You can digitally sign and e-file without the need to download or to print the forms. You have the option to download and print the forms and file in person.
WHICH TYPE OF INJUNCTION TO ASK FOR?

Take Online Screening
Step through this screening tool, which asks a few general questions without asking for any personal information, to suggest the most suitable of the six injunctions available in Florida.
If you already know which injunction you need, you can skip to the next section.
INJUNCTIONS (Restraining Orders)

Domestic Violence Injunction
Domestic Violence (Florida Statutes 741) means any abuse, physical harm, threats, or controlling behavior where the abuser is a current or former spouse, romantic partner who lived together, a coparent, or a family or household member.

Stalking Injunction
Stalking (Florida Statutes 784) is when someone purposefully follows you repeatedly over a period of time for no legitimate reason, and so distresses you and makes you feel fear for your safety.

Repeat Violence Injunction
Repeat Violence (Florida Statutes 784) means any assault, battery, sexual battery, or stalking by an abuser against a victim. Repeat Violence means two or more incidents committed by the abuser, with at least one within the last six months.

Dating Violence Injunction
This injunction is for violence between individuals who dated or are dating but haven’t lived together. The dating relationship must have existed in the past six months, must have been romantic, and must have involved continuous exchanges. Parties who have lived together must opt for the Domestic Violence Injunction.

Injunction for Protection Against Exploitation of a Vulnerable Adult
This injunction is designed to protect elders or adults with disabilities who are at risk of exploitation, abuse, or neglect, often by caregivers, family members, or others in a position of trust.
Sexual Violence Injunction
When the abuser is not a dating partner or family member, and the abuse is any of: sexual battery defined by Chapter 794, lewd and lascivious act upon or in the presence of a child younger than 16, lured or enticed a child as described in Chapter 787, required a child to sexually perform as in Chapter 827, or committed any forcible felony where a sexual act was committed or attempted.

WHAT HAPPENS AFTER YOU FILE
Step 1
A judge reviews your petition
The Clerk’s office sends your petition to a judge. If the judge finds that it has merit, the judge enters a temporary injunction.
Step 2
The respondent is served
The respondent must be personally served with the petition, the notice of hearing and the temporary injunction.
Step 3
You go to the hearing
The hearing is set within 15 days of the temporary injunction, usually on a Tuesday afternoon. You must attend, or your case will be dismissed. To postpone it for a medical reason, you need a doctor’s note.
Step 4
The judge decides
At the hearing, the judge decides whether to grant a final injunction. A final injunction stays in effect until the court changes or ends it, unless the judge sets an end date.
Step 5
Ask for a Hope Card (Optional)
If you receive a final injunction, you can ask the Clerk for a free Hope Card, a wallet-sized card with the key details of your injunction. Ask when the final judgment is entered or any time before the injunction expires. The card is ready within three business days and is valid for two years or until the injunction expires, whichever comes first.
The request form is on the Clerk’s injunction page.
